Required statement
“this food was made in a home kitchen, is not regulated or inspected and may contain allergens”
For direct sales (farmers market, home, farm), no label is required, but the producer must inform the consumer that the food ‘is not certified, labeled, licensed, packaged, regulated or inspected’ (no set wording or method; a sign or verbal notice is common). The quoted label statement is mandatory only when non-potentially hazardous homemade food is sold through a third-party retail location or grocery store. It must be ‘clearly and prominently labeled’, kept off shelves holding licensed products, and the store must post a sign saying the food has not been inspected. No font size specified.
